Contracts with website developers and hosting companies
There are several aspects to the website development agreement, especially if there are difference for the designer once the site has been established. The main issues that should be considered are set as follows …
Functional Specifications
The functional specification defines what the manufacturer of software for the delivery. Approproate provisions must be incorporated into the contract to ensure that the software developer has promised to deliver – the functional specifications delinate this should clear. This naturally means that the specification must be made in writing – it is highly desirable to have a written specification detail to your website is agreed between you and the designer, so that everyone knows what to expect from the beginning. This ensures that the creator knows what he has to do to his fees, particularly if they are fixed. You also need to consider the elements that can be extras and how much they will cost.
Domain Name Registration
Ensure that the web designer is obliged to register the domain name (If he / she is doing) in your name, not his own name. Also make sure you're not leasing the name of the designer.
Guarantee Freehold – Guaranteed
Ensure that the contract includes a guarantee by the designer that all the content it provides is free of third party property rights Intellectual and you compensate on a "full compensation" for any costs, claims and liabilities arising from breach of warranty.
Assignment of copyright
Try to make sure you get the copyright in the site. It is reasonable for the designer normally require payment before the copyright is granted. On large projects you would like to include a provision whereby the copyright in the material produced agreed to specific steps that will pass once the bill for this particular stage has been granted. This way, you not a situation of total loss if you fall with the designer during the contract.
Configuration and software performance and legal
Where needs special legal for your site, make sure the designer understands these and also make sure they are obliged to ensure that everything they have to do willingness to work legally. You should not expect the designer to advise you and ensure compliance with legal, but you must wait for specific instructions you give on this subject (after consulting your lawyer on the subject) to follow and that the work be guaranteed. There may be issues such as prevention pending orders without the first customer to accept the terms of the company using a pop-up.
Maintenance Bonds
When there are obligations under maintenance on your designer, you need similar provisions regarding the future development of the site (by example with regard to copyright, etc..) Where are they also host your site you need to have assurances about safety information when taken by visitors to the site and also when it is stored by the host society and also when it onwardly is forwarded to your own server / PC. You'll also want some sort of agreed service standard for downtime (if they can not guarantee their services are up at least 97% of the time in any given month, you should probably look elsewhere) and the response to requests for support and treatment of emergencies.
